A. Smuggers getting less into country

By VIOREL LUPU Post Staff Writer

Government and tobacco industry lobbyists say a six-month-old state initiative to stem the tidal wave of smuggled tobacco rolling over Ukraine's borders is beginning to get results.

According to the Ukrainian Tobacco Association, the amount of cigarettes entering the country illegally is down by about 35 percent this year compared to last year.

The results of the government campaign, dubbed Operation Tobacco, were the focal point of a roundtable organized by Phillip Morris on July 19 to coincide with the release of a report prepared by the International Center for Policy Studies and the Coalition for Intellectual Property Rights.

The 'Operation Tobacco campaign has overseen the seizure of Hr 4.3 million worth of illicit tobacco products since the beginning of the year, according to Oleksandr Berejnyi, the head of the Ukrainian Customs Service and deputy head of the Ukrainian government's anti-smuggling administration. The state didn't even keep such figures last year, Berejnyi said.

The government has also been clamping down on retail sellers of illegal tobacco as well as domestic producers operating outside the law. According to State Tax Administration representative Volodymyr Antipov, government agents uncovered caches of illegally imported tobacco products that had already been brought into the country, as well as clandestine production facilities.

"Unlike alcohol, the illegal tobacco trade did not attract much government, attention in previous years;" Antipov said. "Today, we are developing programs to train specialists to deal with the illegal tobacco trade."

Despite the recent progress, Ukraine still has a massive problem fighting tobacco contraband on its borders, as the report released at the roundtable makes clear.

The report cites Ukraine's porous borders, ineffective law-enforcement and excessive state control, over legal tobacco as among the reasons why an estimated 22 billion cigarettes worth some Hr 500 million were brought into the country illegally in 2000, costing the state countless tnillions of hrynvas in tax revenues.

More alarmingly, the report alleges that "a strong correlation" exists between cigarette and alcohol smuggling and the drugs ana arms trade.

The tobacco-smuggling problem worsened acutely in 1999 as the main traffic routes began shifting from the Moldovan border to the border with Russia. The volume of illegal cigarette traffic over the Russian-Ukrainian border has more than tripled since the beginning of 1999, according to Berejnyi.

As interdiction efforts bear more fruit, the government is faced with yet another problem: What to do with the confiscated goods?

The law used to permit the government to sell confiscated tobacco to military personnel, inmates and pensioners in retirement homes. The provision was effectively repealed when a new law took effect last year. The present law, ratified on July 10, 2000, specifies that confiscated goods be "liquidated" but doesn't specify how. Without a legal basis to dispose of the contraband, it is being stored in government warehouses.

B. Security Service floats another Web registration plan

Data provided by Bigmir.net

A State Security Service (SBU) plan to create a comprehensive register of Ukrainian Web sites is drawing sharp criticism and is fraught with technical challenges.

The SBU proposal is the second in as many months involving the Internet. Critics say both plans are attempts to strengthen the SBU's grip on the nation's Web activity.

Last month, the SBU launched a plan to create a nonprofit group to register and issue Ukrainian Internet addresses. Now the security service-wants to compile a list of Ukraine's Web sites.

While it is possible to identify sites hosted in this country by their .ua extensions, locating, identifying and compelling the registration of sites hosted by computers outside Ukraine is burdened with a bevy of practical, legal and technical problems.

Sites like "business.com.ua" would be relatively easy for the SBU to locate, as would all other Web addresses ending in .ua (the so-called UA Zone).

But the Internet doesn't pay much heed to international boundaries, and it is easy for Ukrainians to register Web sites with .com extensions that don't indicate a nation of origin. Likewise, individuals can freely set up personal and even business Web sites using any of a number of free services like Yahoo's GeoCities.

Critics say that the SBU lacks jurisdiction over sites hosted on computers outside Ukraine.

Even the security service doesn't seem certain what it wants to achieve. Although it has announced its basic proposal, little specific information has been released.

"The only thing we want is for all domains, or pages on the Internet, to he listed in a registry, much like a telephone directory," said Security Chief Volodymyr Radchenko. The SBU plans to post the registry on the Internet, he added. The project's purported goal is to prevent Internet-basedintellectual property piracy, Radchenko said.

Radchenko maintained that although the registry will be a creation of and funded by the security services, the SBU would not directly administer the register.

The plan drew sharp criticism almost immediately. One day after the SBU announced the registration plan, State Communications and Information Committee chairman Oleh Shevchuk called the plan "technically unfeasible."

Shevchuk was subsequently fired as committee chairman by President Leonid Kuchma. It is unclear if his criticism of the plan played a part in his ouster.

The SBU's newfound interest in Ukrainians' Internet activity has been slammed in the local press.

Critics argue that security officials are merely trying to monitor and control Internet communication within the country. "I don't see any justification for the security service to get involved in the Internet sector," said Oleksandr Bernatovych, director of Kyiv-based IT Consulting. "There are no state security interests in the sector."

Ukraine's Internet use has risen dramatically during the past year. In large part, the surge has been linked to interest in alternative and opposition news sites by the country's estimated 500,000 regular Web surfers. Traditional mass media sources in Ukraine, such as television and newspapers, are generally controlled by influential business groups with close ties to the government.

C. Reinvented restoration firm finds work with local government

When funds for preservation of Ukraine's historical sites dried up after the Soviet Union collapsed, among the large number of organizations left without work was Ukrrestavratsiya, an engineering and construction firm that specialized in the maintenance and restoration of architectural monuments.

Without funding or a ready market for its services, Ukrrestavratsiya seemed destined to close its doors. Instead, the firm has successfully reinvented itself and is now a leading participant in the beautification of Kyiv.

Ukrrestavratsiya's main challenge was to find a new market for its services - no easy task since little demand existed for the firm's specialized expertise. Ukrrestavratsiya could, of course, have tried entering the general construction market, but then it would have had to compete with large construction firms with far more experience.

Instead, Ukrrestavratsiya found its commercial niche as a general contractor for the Kyiv City Administration, renovating the capital's architectural sites. Among the firm's major projects have been the construction of the monument to Princess Olga on Mikhailivska Ploshcha, the reconstruction of the Mikhailivsky Cathedral, the reconstruction of the Uspenski Cathedra in the Pecherska Lavra complex and the renovation of the National Philharmonic Theater.

Among the jobs the firm has lined up for the future is the renovation of the historic Rizda Khristova (Christ's Nativity) Church in Podil. The church is best known as the venue for the funeral service of Ukrainian poet Taras Shevchenko.

According to Vyacheslav Pshuk, assistant to the president of Ukrrestavratsiya, work for the

City Administration has became the firm's major source of revenue, and Ukrrestavratsiya has become one of the main contractors for such work in Kyiv.

Contracts did not come easy at first, though. To ensure a steady flow of work, Ukrrestavratsiya had to work competitively and be creative. One of the firm's innovative ideas was to drill artesian wells to provide drinking water for Kyiv residents. It built the first 30 wells at different locations all over the city. The effort paid off, however, and the firm continues to get virtually all of the city's restoration work.

Today, the firm is taking part in the Maidan Nezalezhnosti and Bessarabska reconstruction projects. It is also a subcontractor for the renovation of Kyiv's 70-year-old central railway station.

According to Pshuk, Ukrrestavratsiya struggles with the same problems as any other business in Ukraine: unstable economic conditions, red tape and bad legislation. It does face at least one unique handicap, though: Pshuk said that the law that prohibits private ownership of historical sites means there are few commercial projects in this area.

Pshuk also hinted that taking so much work from a single source can lead to cash-flow problems, since the City Administration can be slow to pay its bills.

Despite all the problems, though, Pshuk remains optimistic about the firm's future - whatever direction Ukraine's economy takes.

"If economic stabilization continues, and I believe it will, then we will have plenty of work," he said. "And should the situation get worse, we will still survive, as we have done in the past."

D. Chorus brings bandura music to Ukraine

By DANA LISS Post Staff Writer

Many immigrants choose to sever ties with the past and immerse themselves in their adopted culture with no intention of ever returning to the land they left behind. That's not the case with a troupe of ethnic Ukrainians who have been promoting the musical traditions of their homeland for more than five decades while living half a world away.

Ever since independence, the Detroit-based Ukrainian Bandurist Chorus has periodically brought the music of the bandura back to Ukraine through a series of concerts designed to entertain and enlighten.

"In 1991 and 1994 we brought Ukrainian music from the diaspora back to Ukraine, and the people were amazed," said chorus president Ana-toly Murha.

For more than 50 years, the 55-member all-male Bandurist Chorus has been performing around the world, playing both traditional and modern compositions. The chorus has packed concert halls in the United States, Europe, Canada and Australia and has been praised for both the quality and energy of its performances, Murha said.

In 1992, the chorus received the prestigious Taras Shevchenko state prize in Ukraine, honoring organizations and individuals for excellence in the arts.

A cross between a lute and a harp, the bandura has between 20 and 65 strings. It is capable of emulating the delicacy of a harpsichord but with a wider range of dynamics and tonal control.

The chorus has come a long way since its forced flight abroad in 1949.

"It is amazing how this chorus is still intact, considering how much it has endured," said E. Morgan Williams, director of Arts Ukraine Information Service, a Web site dedicated to promoting Ukrainian arts and culture.

Indeed, the history of the chorus reads much like a novel.

It first formed in Lviv in 1918 by Hnat Khotkevycha, a writer, composer, theater director best known for his literary works, the “The Prodigal Son” and the highly acclaimed play “Bohdan Khmelnytsky”.

A railway engineer by profession, Khotkevycha fled from Kharkiv after leading the workers’ strike in 1905. In western Ukraine, he embraced Ukrainian culture and absorbed himself in writing about it, while perfect ing the art of the bandura.

Dubbed the "Voice of Ukraine," the instrument became the symbol of Ukrainian art, and nationalism - especially after the Soviet authorities banned the bandura in the 1930s.

Moscow took such a negative view of the bandura that authorities took to persecuting players, and Khotkevycha was executed in 1938.

But his Ukrainian Bandurist Chorus survived.

After enduring both Soviet and Nazi oppression, the chorus, led by its conductor Hryhory Kytasty, made the journey to the United States via Germany with the help of Allied forces. Kytasty set up shop in Detroit and the chorus continued playing in exile.

Some of the players, like Murha, are the progeny of the originzl group and grew up playing the bandura. His father, Volodumyr, was born to Ukrainian parents in Germany during World War II and later learned to play the bandura by Kytasty after the family moved to the United States.

When the chorus came to Ukraine for the first time following the country's independence in 1991, people were in a state of euphoria. But that elation eventually dimmed as political and economic turmoil gripped the country. The hard times were difficult for the chorus to deal with at first.

"This time around, we understand the struggles that a growing nation must go through," Murha said. Unlike many Ukrainians who never left the nation, the chorus has a positive impression of the country. "We feel that it's an amazing time to be in Ukraine."

Це стосується перекладу назв інших держав (Great Britain — Велика Британія, Britain — Англія), стійких словосполучень (місія доброї волі — good will mission; люди доброї волі — people of good will; глобальна війна — global war; переговори на високому рівні — top level talks та ін.).

Виняток становлять найбільш уживані звороти, наприклад, status quo, quorum, persona grata, persona nongrata, idee fixe, homo sapiens, de facto, de jure, a priori та ін.

The General Assembly shall consist of all the Members of the United Nations.

The General Assembly shall adopt its own rules of procedure. It shall elect its President for each session.
